When someone publishes a false statement that has the tendency to harm the reputation of another, a defamation of character has occurred. Publication is the communication of the false statement to a person other than the plaintiff. Defamatory statements could be written, which is called libel, such as an email, a letter, an article in a newspaper or even a picture drawn on a wall, could be construed as defamatory. On the other hand, if the defamatory statement is oral, it is called slander. The main distinction between slander and libel is that in most cases of slander, the plaintiff must show actual harm of a pecuniary nature; while in most libel cases, such harms are presumed.
